Welcome to Fertility Signal. These Terms of Service ("Terms") govern your use of our website (fertilitysignal.com), patient portal, and fertility testing services (collectively, the "Services") operated by the Marylebone Diagnostic Centre ("we", "us", "our"), a company incorporated in England and Wales with clinical operations at 73 Baker Street, London W1U 6RD.
By accessing our website, booking a test, or using our patient portal, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Our Services
Fertility Signal provides private male fertility diagnostic services, including:
- Semen analysis (sperm count, motility, morphology)
- DNA fragmentation testing
- Male hormone profile testing
- The Fertility Signal Score - a composite fertility score based on your results
- A secure patient dashboard for viewing your results and recommendations
- Clinician review and personalised protocol recommendations
2. Eligibility
Our Services are intended for adults aged 18 and over. By using our Services, you confirm that you are at least 18 years old and legally capable of entering into a contract.
3. Booking and payment
- Tests are booked online or by phone. Payment is required at the time of booking.
- Prices are shown in GBP and include VAT where applicable.
- We accept major credit and debit cards through secure payment processors.
- Cancellations made more than 24 hours before your appointment are eligible for a full refund. Cancellations within 24 hours may be subject to a fee.
4. Patient portal access
When you book a test, we create a secure patient account for you. You are responsible for:
- Keeping your login credentials confidential
- Notifying us immediately if you suspect unauthorised access
- Using the portal for lawful purposes only
- Not sharing your account with others
5. Clinical disclaimer
The Fertility Signal Score and associated recommendations are provided for informational and clinical support purposes. They do not replace medical advice from your GP or specialist. You should always consult a qualified healthcare professional before making medical decisions.
While we take every step to ensure accuracy, laboratory results and interpretations may vary. If your results indicate a clinical concern, we strongly recommend booking a review appointment.
6. Intellectual property
All content on the Fertility Signal website and patient portal - including the Fertility Signal Score methodology, logos, text, images, and software - is owned by the Marylebone Diagnostic Centre or its licensors. You may not copy, reproduce, or distribute this content without prior written permission.
The Fertility Signal Score, its interpretation logic, and all associated technology are proprietary to the Marylebone Diagnostic Centre.
7. Prohibited use
You agree not to:
- Use our Services for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Interfere with the security or functioning of our platform
- Copy, modify, or reverse-engineer our software or content
- Submit false or misleading information
- Impersonate another individual or clinician
8. Limitation of liability
To the fullest extent permitted by law, our liability for any claim arising from your use of the Services is limited to the total amount you paid for the specific test giving rise to the claim.
We are not liable for indirect, consequential, or incidental damages, including but not limited to loss of profits, data, or opportunity, arising from your use of our Services.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
9. Termination
We may suspend or terminate your account if you breach these Terms or use our Services in a way that causes harm to us or other users. You may close your account at any time by contacting us. Medical records will be retained in line with UK healthcare regulations.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of our Services after changes constitutes acceptance. Significant changes will be communicated by email or notice on our website.
11. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
